Reproduction and Use of SCRC Materials

The Southern Illinois University Carbondale (SIUC) Special Collections Research Center (SCRC) provides copies of materials to facilitate private study, scholarship, and research.  You are welcome to use materials in our collections that are in the public domain and to make fair use of copyrighted materials as defined by the Copyright Law of the United States of America and Related Laws Contained in Title 17 of the United States Code.


The copyright law of the United States (Title 17, U. S. Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproductions. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copy order if, in its judgment, fulfillment of the order would involve violation of the copyright law.

Request to reproduce items

A request to copy SCRC material constitutes an agreement that you will not reproduce, transfer, distribute, broadcast, publicly display, offer for sale, or otherwise use or publish any material subject to copyright, or a portion thereof, in excess of fair use, as defined by copyright law, without the express permission of the copyright holder.

Please note that while SCRC owns the materials in our collections, we usually do not own the copyright to these materials, except where it has been explicitly transferred to SIUC. You are solely responsible for determining the copyright status of materials and obtaining permission to use material from the copyright holder. SCRC cannot provide permission to use materials when SIUC is not the copyright holder.

We reserve the right to limit the number of copies made; to restrict the use of rare and valuable items; and to deny a request because of copyright regulations, privacy rights, donor-imposed regulations, or other rights-related issues.

Photocopies

  • $0.25 per page for letter and legal size
  • $0.50 per page for 11 x 17
  • Photocopy labor charges (for orders over 100 pages)
    • 101-150 pp.: $5
    • 151-200 pp.: $10
    • 201-250 pp.: $15
    • 251-300 pp.: $20
    • 301-350 pp.: $25
    • etc.

High resolution digital scans

  • $5 each up to 20 scans
  • $10 each after 20 scans

Audio materials

  • $13 for up to 60 minutes
  • $17 for 61-90 minutes
  • The following formats can be digitized:
    • 0.5 inch audio reel, 6 inch diameter
    • 0.5 inch audio reel, 10.5 inch diameter
    • Vinyl disc 33/45/78
    • Cassette tape

Payment required in advance. Work begins after receipt of payment. Payment by cash, money order, or a check drawn on a U.S. bank can be mailed to us.  To pay by credit card please contact us for additional instructions.


Personal cameras

With some exceptions and subject to certain conditions the use of cameras and scanners is permitted. There is no charge for use of cameras. Special Collections staff may forbid the use of cameras if you mishandle materials, or if your equipment poses any risk to our materials or causes disruption in our reading room.


Permission to Publish

The consent of SCRC as the owner of the physical materials does not address copyright issues that may affect publication rights. Although content posted publicly by SCRC is believed to have no known U.S. copyright or other restrictions, it is the sole responsibility of the user of such materials to investigate the copyright status of any given work and to seek and obtain permission where needed prior to any distribution or publication. If the content in question is under copyright, permission to publish must be sought from the owners of the rights, typically the creator or the heirs to his or her estate unless covered by the principle of fair use. Copyright law protects unpublished as well as published materials. Any use of content made publicly available is subject to the user or recipient's agreement to indemnify and hold harmless the Special Collections Research Center, Southern Illinois University Carbondale or its employees, trustees, or agents from and against all suits, claims, actions and expenses. By your use of these materials, you agree to these responsibilities, including the noted legal protections of Southern Illinois University.

If questions arise concerning the small number of collections for which Southern Illinois University does own copyright (generally noted in the catalog records or online guides) or for materials in the University Archives, please contact SCRC.

Further, some library donors have placed restrictions on the use of materials that must be honored. Such restrictions are generally noted in the catalog records or online guides to SCRC materials, and Library staff will provide informational assistance in these cases.

Southern Illinois University Carbondale must always be cited as the source of the content when published or otherwise distributed.


Use Fees

Materials owned and copyrighted by SCRC may be published subject to approval and fees may be charged for use. “Publication” includes: print, electronic (online or on other media), film, microfilm, or videotape. Permission to use materials must be obtained in advance or in writing from SCRC by completing the Permission to Publish/Display/Cite Materials Form

The fees listed below are assessed in addition to duplication charges (photocopy, scan, or other) and are to be paid in advance of publication. Only those images actually used in publication are subject to fees. If a request covers more than one form of publication, the fees are cumulative.

Publication fees are waived for SIUC students working on their theses or dissertations.

  • Commercial use (within text): $50
  • Commercial use (book cover): $200
  • Non-commercial/academic press: $25
  • Web page: $10
  • Exhibit display (non-profit): $15
  • Exhibit display (commercial): $75

In receiving a reproduction from our holdings, you assume all responsibility for infringement of copyright or other rights in your use of the material. You must agree  to defend, indemnify, and hold harmless the Special Collections Research Center, Southern Illinois University Carbondale and its Trustees, officers, agents and employees, from and against any and all liabilities, losses, demand, penalties, costs, expenses,  attorneys’ fees, lawsuits, fines, judgments, or causes of actions, including but not limited to claims relating to infringement of copyright, trademark, invasion of rights of privacy or publicity, or libel that arise either directly or indirectly from any use by the requestor of the images and/or materials provided by the Special Collections Research Center,  Southern Illinois University Carbondale or its employees, Trustees, or agents.
